Welcome to the ApTask website located at aptask.com together with any materials and services available therein, successor site(s) thereto, or the ApTask Direct functionality (the “Site”), which is operated by FinTech Consulting LLC dba ApTask and its affiliates (“ApTask,” “we,” or “us”). These Terms of Use (“Terms”) govern your use of and access to the Site and constitute a legally binding agreement between you and ApTask. These Terms incorporate additional terms posted by ApTask through the Site or otherwise made available to you.
We may change these Terms from time to time by posting updated Terms on the Site or notifying you through reasonable means. Changes will not apply retroactively to disputes or issues arising prior to the effective date of the revised Terms.
The “Last Updated” legend above indicates the latest revision. ApTask reserves the right to modify or discontinue the Site, in whole or part, at any time without notice or liability.
Eligibility
By using the Site, you represent that you are of legal age to enter into these Terms. If you are using the Site on behalf of an organization (an “Organization”), you affirm that you have the authority to bind the Organization to these Terms, and all references to “you” and “your” include both you and the Organization.
The Site is operated from the United States and may not be appropriate or available in other jurisdictions. Any use of the Site outside the United States is at your own risk, and you must comply with applicable laws.
Consent to Communications
When you affirmatively submit a form on the Site (such as a contact form, application, or newsletter signup) and check the corresponding consent checkbox, you provide prior express written consent under the Telephone Consumer Protection Act (47 U.S.C. § 227 “TCPA”) and analogous state laws to receive the specific categories of communications described next to that checkbox. This may include:
- Transactional messages (application confirmations, interview scheduling, onboarding notices).
- Job alerts, employment opportunities, and recruiter follow-ups relevant to your submitted profile.
- Marketing messages, newsletters, and event invitations from ApTask.
- Messages sent using an automatic telephone dialing system, artificial or prerecorded voice, or SMS short code.
Message and data rates may apply. Message frequency varies. Your consent is not a condition of any purchase or the receipt of any goods or services from us.
You may withdraw your consent to receive marketing communications at any time by (a) following the unsubscribe instructions in any email, (b) replying “STOP” to SMS communications, or (c) emailing us at [email protected]. Cookies and Tracking Technologies
The Site uses cookies and similar tracking technologies. When you first visit the Site, you will see a consent banner that allows you to either accept all cookies or decline non-essential cookies.

License
Subject to your compliance with these Terms, ApTask grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use.
All content, information, and materials available on the Site are the exclusive property of ApTask or its licensors and are protected under U.S. and international laws. You are prohibited from using the Site in ways not explicitly permitted under these Terms.
User-Submitted Materials
The Site allows you to upload résumés, job-related information, references, and other content (“Submitted Materials”). You retain ownership of your Submitted Materials.
You grant ApTask a limited, worldwide, royalty-free, non-exclusive, non-transferable, revocable license to use, reproduce, store, transmit, and display your Submitted Materials solely for the following purposes:
- Evaluating your fit for open roles, whether or not you applied to a specific position.
- Presenting anonymized or client-approved details of your background to prospective employers or engagement clients in the ordinary course of recruiting and placement.
- Improving and operating the Site and our matching and analytics tools (using de-identified or aggregated data where reasonably possible).
- Complying with legal, tax, employment-verification, and audit obligations.
This license terminates when you exercise your right to delete your Personal Information under our Privacy Policy, subject to the retention exceptions described therein (e.g., legal recordkeeping, active engagements, security). We do not create derivative marketing works from your résumé, publicly display your Submitted Materials on the Site, or sell them to third parties.
By submitting materials, you affirm that you own or have permission to provide such materials, that they are accurate to the best of your knowledge, that they comply with applicable laws, and that they do not infringe third-party rights (including copyright, trademark, right of publicity, or confidentiality obligations owed to prior employers).
Microsoft Supplier Security and Privacy Assurance (SSPA) Compliance
If ApTask processes any data on behalf of Microsoft as part of the Microsoft Supplier Security and Privacy Assurance (SSPA) program:
- Privacy and Security Controls: ApTask will implement all required technical and organizational measures to ensure compliance with SSPA standards.
- Incident Reporting: Any data breach or security incident involving Microsoft data will be reported to Microsoft within the required timeframe.
- Data Retention and Deletion: Microsoft-related data will only be retained as necessary for business purposes or as required by Microsoft. Data will be securely deleted upon request or at the conclusion of services.
- Subprocessors: ApTask will ensure all subprocessors used comply with Microsoft’s SSPA standards.
Rules of Conduct
You agree not to:
- Post offensive, illegal, or infringing content.
- Distribute malware or disrupt the Site's functionality.
- Harvest information or engage in unauthorized scraping or data mining.
- Reverse-engineer, decompile, or tamper with any portion of the Site.
ApTask reserves the right to monitor, remove, or restrict any content or user activity violating these Terms.
Third-Party Links and Services
The Site may contain links to third-party websites, tools, or services (including, without limitation, applicant tracking systems, calendar and video-conferencing platforms, job boards, professional networking sites, and payment processors) that are not owned or controlled by ApTask. We provide these links for convenience only. We do not endorse or assume responsibility for the content, privacy practices, or operation of any third-party site or service, and your interactions with them are governed by their own terms and privacy policies.
Copyright and DMCA Notice
ApTask respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, ApTask will respond to properly submitted notices of alleged copyright infringement.
If you believe your copyrighted work has been copied and posted on the Site in a way that constitutes infringement, please provide the following information in writing to our designated agent:
- An electronic or physical signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it (URL, page, or upload identifier).

ApTask has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed repeat infringers. Counter-notifications may be submitted to the same agent using the requirements set forth in 17 U.S.C. § 512(g).

ApTask is committed to making the Site accessible to as many users as possible, consistent with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Accessibility is an ongoing effort. TO THE FULLEST EXTENT PERMITTED BY LAW, APTASK AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
Without limiting the foregoing, ApTask does not warrant that: (a) the Site will meet your requirements or be uninterrupted, timely, secure, or error-free; (b) job listings, employer information, or candidate information displayed on the Site are accurate or current; (c) the results obtained from use of the Site will be reliable or produce a placement, hire, or employment outcome; or (d) files or communications transmitted through the Site are free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the disclaimers apply to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless ApTask and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your Submitted Materials; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; (d) your negligent, willful, or wrongful conduct; or (e) any misrepresentation you make to ApTask or through the Site. ApTask reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification, in which case you agree to cooperate with our defense.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL APTASK OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, arising out of or relating to these Terms or your use of or inability to use the Site, whether based in contract, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages.
APTASK’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU HAVE PAID TO APTASK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. These limitations apply regardless of the failure of any essential purpose of a limited remedy. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the limitations apply to the maximum extent permitted by law.
Dispute Resolution; Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution First
Before filing a claim, you agree to attempt to resolve the dispute informally by emailing [email protected] with a description of the claim and the resolution you seek. If we cannot resolve the dispute within sixty (60) days, either party may proceed to arbitration.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that is not resolved informally will be resolved through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules & Procedures (or, if the amount in controversy exceeds $250,000, its Comprehensive Rules) before a single arbitrator. Arbitration will take place in Middlesex County, New Jersey, or by videoconference at either party’s election. The arbitrator’s award will be final and enforceable in any court of competent jurisdiction. This Section is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
Class-Action Waiver
YOU AND APTASK EACH WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity, and the arbitrator may not consolidate or aggregate claims of multiple persons. If a court determines that this Class-Action Waiver is unenforceable as to any particular claim, that claim (and only that claim) will proceed in court, and the arbitration agreement will remain in effect for all other claims.
Exceptions and Opt-Out
This arbitration agreement does not apply to (a) claims that qualify for small-claims court; (b) claims to enjoin or seek injunctive relief for infringement of intellectual property rights; or (c) any claim that applicable law makes non-arbitrable. You may opt out of this arbitration agreement by mailing written notice to the address in the “General” section within thirty (30) days of first accepting these Terms; the notice must include your name, address, and an unambiguous statement that you wish to opt out.
Force Majeure
ApTask will not be liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemic or epidemic, government action, labor disputes, internet or telecommunications outages, third-party service failures, or cyberattacks.
Termination
ApTask may terminate your access to the Site for violations of these Terms or any applicable law. Upon termination, your right to use the Site ceases immediately.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Subject to the Dispute Resolution section above, you agree that any action not subject to arbitration will be brought exclusively in the state or federal courts located in Middlesex County, New Jersey, and you consent to personal jurisdiction and venue in those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Electronic Communications and Consent to E-Sign
You consent to receive communications from us in electronic form. Electronic communications, including these Terms, our Privacy Policy, notices, and disclosures, satisfy any requirement that such communications be provided in writing under the U.S. Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq., the “E-SIGN Act”). You may withdraw this consent by emailing [email protected], but doing so may limit our ability to provide certain Site services.
General
Entire Agreement. These Terms, together with our Privacy Policy and any additional terms posted on the Site or agreed to in writing, constitute the entire agreement between you and ApTask regarding your use of the Site and supersede any prior or contemporaneous understandings.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or of any other provision.
Assignment. You may not assign or otherwise transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
Survival. Sections that by their nature should survive termination will survive, including the User-Submitted Materials license (as modified by your privacy rights), Disclaimer of Warranties, Indemnification, Limitation of Liability, Dispute Resolution, Governing Law, and this General section.
